DACA, Dreamer, D-3 Waiver 발표
국무부 Department of State에서 8 USCS § 1182(a) 로 비이민 비자 발급이 거절된 경우 (illegal entry 불법입국; unlawful presence 불법체류), 어느 상황에서 D3 Waiver (해당 비이민 비자에만 사용가능한 조건부 사면)을 추천할 것인지 Update를 발표했습니다. https://travel.state.gov/content/travel/en/News/visas-news/easing-the-nonimmigrant-visa-process-for-u-s–college-graduates-.html
영사는 비이민 비자 심사 후 여러 상황을 고려해서 D3 Waiver를 추천하게 되는데, 추천을 받으면 미국 국토안전부의 U.S. Customs and Border Protection’s Admissibility Review Office에서 심사를 하게 됩니다. 새로 추가된 것은 고학력자가 H-1B 등의 신분으로 입국해서 일하는 것으로 얻는 미국의 국익을 심사에 반영하는 것 입니다. 또한, 이러한 상황에서 급행처리로 심사할 것을 요구할 수 있는 부분도 추가되었습니다. 또, 영사의 추천을 받지 못했을 경우에 제한된 상황에서 국무부에 직접 판단을 요구하는 것에 대한 Update도 있습니다.
9 FAM 305.4-3(C), 4-3(E)(2), 4-3(F)에 다음 사항을 추가하였습니다.
4-3(C) Factors to Consider When Recommending a Waiver (D3 Waiver 추천 시 고려사항): c(3). “NOTE: In general, you should consider cases where the applicant has graduated with a degree from an institution of higher education in the United States, or has earned credentials to engage in skilled labor in the United States, and is seeking to travel to the United States to commence or continue employment with a U.S. employer in a field related to the education that the applicant attained in the United States, to have a positive effect on U.S. public interests;.”
4-3(F): Waiver Expedite Requests (D3 Waiver 급행처리): b. “As described in 9 FAM 305.4-3(C)(c)(3) with regard to recommending a waiver, there is a clear and significant U.S. public interest in asking CBP/ARO to expedite a waiver request if the applicant has graduated with a degree from an institution of higher education in the United States, or has earned credentials to engage in skilled labor in the United States, and is seeking to travel to the United States to commence or continue employment with a U.S. employer in a field that requires the education that the applicant attained in the United States.“
4-3(E)(2): When to Submit Applications to the Department for Review (D3 Waiver 추천을 받지 못했지만, 신청자가 요구한 경우): a(4). “Admission to the United States would advance a significant U.S. public interest including the positive effect of the planned travel on U.S. public interests described above in 9 FAM 305.4-3(C)(c)(3).”
